ABATE of Arizona Expands Secured Load Law on "Secure the Load" Day; Governor Remains Silent

Phoenix, AZ – June 7, 2024 – Yesterday marked "Secure the Load" day in Arizona, a significant initiative led by ABATE of Arizona represented by EPIC Policy Group to enhance road safety and protect Arizona's citizens. This year, ABATE of Arizona successfully ushered an expansion of the secured load law, championed and sponsored by Senator Shawnna Bolick. Despite the importance of this day, the Governor’s office did not acknowledge the efforts and significance of "Secure the Load" day.

 

The expanded secured load law, requires all motorists to secure their loads more stringently, ensuring that items transported on public roadways are adequately fastened and unlikely to cause road hazards. This legislative advancement comes as a response to rising concerns over road safety and the increasing number of accidents caused by unsecured loads.

 

According to the Arizona Department of Public Safety (DPS), there were over 1,100 incidents involving unsecured loads in Arizona last year, resulting in 9 fatalities. Nationally, the National Highway Traffic Safety Administration reports that road debris caused by unsecured loads contributes to over 65,000 crashes annually, leading to 17,203 injuries and 895 fatalities in 2022. These alarming statistics underscore the necessity for stringent regulations and public awareness.

 

Senator Shawnna Bolick, the driving force behind this legislation, stated, "The safety of our roadways is paramount. Expanding the secured load law is a crucial step in reducing preventable accidents and ensuring the well-being of all Arizonans. While I am pleased the Governor signed SB1376 into law, I am disappointed she didn’t recognize yesterday. I will continue to fight for Arizonans and their safety."

 

ABATE of Arizona President, Jim Butsback, emphasized the ongoing commitment to road safety, "While 'Secure the Load' day is a symbolic reminder, securing loads should be a year-round commitment. Every motorist has a responsibility to ensure their cargo is properly secured, preventing potential hazards and saving lives."

 

Despite the Governor’s office remaining silent on this significant day, ABATE of Arizona, continues to lead efforts to promote road safety and legislative advancements. The organization encourages all Arizonans to take proactive measures in securing their loads, highlighting that prevention is the key to reducing road hazards.

Why is Article 2 Section 26 of the Arizona Constitution so important?

The Second Amendment of the United States Constitution guarantees the right to bear arms, and many states have similar provisions in their own constitutions. Arizona's Constitution is one such document that enshrines the right to bear arms in Article II, § 26, which reads, “The right of the individual citizen to bear arms in defense of himself or the State shall not be impaired.” This provision is so important because it recognizes the fundamental right of citizens to protect themselves and their communities. The right to bear arms is deeply ingrained in American culture and history, dating back to the country's founding. The Second Amendment was added to the Constitution in 1791 to ensure that citizens could arm themselves to defend against tyranny and oppression, whether from a foreign invader or a domestic government. This right has been upheld by the Supreme Court in several landmark cases, including District of Columbia v. Heller (2008) and McDonald v. Chicago (2010).

Arizona's Constitution takes this right a step further by explicitly stating that the individual citizen's right to bear arms cannot be impaired. This provision acknowledges that the right to self-defense is a fundamental human right that cannot be taken away by the government. It also recognizes the importance of individual responsibility and accountability in protecting oneself and one's community. Article II, § 26 also acknowledges the role of citizens in defending the State. While law enforcement officers and the military have a critical role in protecting the State, they cannot be everywhere at once. Citizens who are trained and authorized to carry firearms can act as a force multiplier, deterring criminal activity and responding to threats in a timely manner. Know your rights!

The priest-penitent privilege laws need to be changed to protect children

As a former pastor and advocate for the protection of children, I strongly believe that the priest-penitent privilege should be re-evaluated in Arizona law. The recent court ruling that upheld the privilege in a sexual abuse case highlights the need for reform in this area. The priest-penitent privilege is an important aspect of religious freedom, allowing individuals to confess their sins to a religious leader without fear of disclosure. However, this privilege should not be used as a shield to protect abusers from prosecution or to allow churches to avoid their responsibility to report abuse. In my opinion, the priest-penitent privilege should be similar to the attorney-client privilege in Arizona law (Ariz. R. Sup. Ct. ER 1.6), which has specific limitations and exceptions. For example, the attorney-client privilege does not apply when a client seeks legal advice to further a crime or fraud, or when disclosure is necessary to prevent harm to others. Similarly, the priest-penitent privilege should not apply in cases where abuse or neglect of a child is suspected or has occurred. This would ensure that clergy members are not able to use their position to facilitate or cover up abuse, and that children are protected from harm. It is time for Arizona legislators to take action and reform the priest-penitent privilege to better protect children from abuse. I urge Arizona Legislators to consider introducing bills to limit the scope of the privilege and to provide exceptions where necessary, in order to ensure that justice is served and children are kept safe. As a former pastor and currently a lobbyist, I believe that protecting children should always be one of our highest priorities, and we must take every step necessary to prevent and punish abuse.
