Response to Censure of Maricopa County Attorney Rachel Mitchell

This was sent to my LD chair. 

I am writing to formally respond to the recent decision of the Maricopa County Republican Committee's Executive Guidance Committee to censure Maricopa County Attorney Rachel Mitchell. It has come to my attention that this censure is a result of her request for sanctions against Kari Lake, a failed gubernatorial candidate who used the courts to promote a false narrative regarding the integrity of the election. I must express my deep concern regarding the decision to censure Attorney Mitchell, as it appears to be misguided and counterproductive.

 

It is important to note that Attorney Mitchell's request for sanctions was rooted in the legitimate aim of deterring frivolous lawsuits surrounding elections. As an experienced and dedicated public servant, she believed it was essential for the courts to put a stop to the influx of frivolous cases brought solely to further a political agenda. Her actions were not only well-intentioned but also aligned with her duty to protect the integrity of the legal system and the interests of the citizens of Maricopa County.

 

Moreover, it is worth highlighting that Attorney Mitchell is a conservative Republican who prioritizes facts over conspiracy theories. She has consistently demonstrated her commitment to upholding the rule of law and ensuring fair and just outcomes. Her election victory last year serves as a testament to her electability and the trust that the citizens of Maricopa County have placed in her.

 

I find it perplexing that the Maricopa County Republican Committee's Executive Guidance Committee has chosen to censure Attorney Mitchell while seemingly ignoring the actions of Kari Lake. It is worth noting that Lake's legal case, which propagated baseless claims of election theft, was completely and unequivocally rejected by the court on two separate occasions. The committee's failure to address Lake's actions raises questions about the consistency and fairness of its decision-making process.

 

Furthermore, the committee's decision to invite "interested, motivated, and qualified Republicans" to run against Attorney Mitchell in the upcoming primary election for the Office of Maricopa County Attorney is concerning. This action has the potential to result in the loss of another GOP officeholder, which could ultimately weaken the party's representation and effectiveness within the county.

 

Finally, I would like to address the issue raised by Attorney Mitchell's request for Lake and her legal team to pay the county's legal expenses. This request stems from the fundamental question of why the taxpayers of Maricopa County should continue to bear the financial burden of defending lawsuits that are baseless and ultimately unsuccessful. Holding the plaintiffs accountable for the costs incurred due to their meritless claims is a matter of fiscal responsibility and fairness.

 

In light of the aforementioned points, I respectfully request that the Maricopa County Republican Committee reconsider its decision to censure Maricopa County Attorney Rachel Mitchell. The censure appears to be an unjust and ill-advised response to her efforts to protect the integrity of the legal system and defend the interests of the citizens of Maricopa County. Upholding the principles of fairness, reason, and respect for the rule of law should be the priority for any political party, including the Republican Party.
